* Free coffee for a year consists of one small Jamaica Blue hot coffee (or, if the winner wishes, one small Jamaica Blue hot beverage) per day for one year from the date after the winner of this competition claims the Prize, provided by Jamaica Blue [Store Name] at its store premises.

Terms & Conditions

Information about the Prize and how to enter forms part of these Terms and Conditions. Participation in this Competition and acceptance of or participation in the Prize or any part of the Prize is deemed acceptance of these Terms and Conditions.

The Promoter is Jamaica Blue Pty Ltd (ACN 059 236 529) of Unit 215F1, Building 215, The Entertainment Quarter, 122 Lang Road, Moore Park NSW 2021 | PO Box 303 Double Bay NSW 1360 (Website: jamaicablue.com.au).

Entry is open to all Australian residents aged 18 years and over as at the commencement date of the Competition and who are registered Jamaica Blue Caribbean Crew Loyalty members at the time of entry. The following are ineligible to participate: (i) directors, officers and employees (and their immediate families) of the Promoter or its related entities; (ii) agencies associated with this Competition; (iii) the franchisee of Jamaica Blue Liverpool Hospital, its directors, officers and employees (and their immediate families).

To enter the Competition, entrants must during the Competition Period spend AUD$15.00 or more in a single transaction at Jamaica Blue Liverpool Hospital and scan their registered Jamaica Blue Caribbean Crew Loyalty Card at point of purchase (Eligible Transaction). Entry into the Competition is automatic once an entrant has completed an Eligible Transaction. Entrants may enter the Competition multiple times.

The Competition starts at 7amAEST) on 6 December 2019 and ends at 5pm (AEST) on 31 December 2019 (Competition Period). No entries outside of the Competition Period will be accepted. The time of entry is the time that an entry is received by the Promoter.

The Competition is a game of chance and the winner will be determined by a random draw of all valid entries. There will only be one winner. The draw will take place at 11am (AEST) on January 6th 2019 at Jamaica Blue’s premises at Unit 215F1, Building 215, The Entertainment Quarter, 122 Lang Road, Moore Park NSW 2021.

The winner of the Competition will be notified by the Promoter by email by 1pm (AEST) on January 7th, 2020. This email will request the winner to claim the Prize by sending a return email to the Promoter by 12pm (AEST) on January 15th, 2020. If the winner does not claim the Prize by such time, the winner will be deemed to have forfeited the Prize and a further random draw will be conducted at 1pm (AEST) on January 15th, 2020 to determine an alternate winner to receive the Prize. The alternate winner will be notified by email by the Promoter by 1pm (AEST) on January 16th, 2020. Such notification will request the alternate winner to claim the Prize by sending a return email to the Promoter by 1pm (AEST) on January 23rd, 2020. If the alternate winner does not claim the Prize by such time the Prize will be forfeited.

The Promoters’ decision in connection with all aspects of the Competition is final and no correspondence will be entered into.

The winner will receive the following which has an estimated value of AUD$1,420.00 (Prize):

one (1) free small hot beverage per day for one (1) year from the day after the winner claims the Prize, provided by Jamaica Blue Liverpool Hospital at its store premises. The free small hot beverage will be linked to the winner’s Caribbean Crew Loyalty Card. The winner must swipe their Loyalty Card at Jamaica Blue Liverpool Hospital, to redeem their free coffee. The winner must remain a registered Caribbean Crew loyalty member in order to redeem the free small hot beverage. The winner is only entitled to one (1) free small hot beverage per day. If the winner fails to redeem the one (1) free small hot beverage on a particular day, it will be forfeited for that particular day and the forfeited free small hot beverage will not be able to be claimed on any other day.

The Prize or any part of it cannot be transferred to a different person, exchanged for other goods and/or services or redeemed for cash. If the Prize or any part of it is unavailable, the Promoters in their discretion reserve the right to substitute the Prize or any part of it with goods and/or services of equal value.

The winner consents to the Promoter using the winner’s name, suburb of residence, State of residence, likeness, image and/or voice in any media for an unlimited period without remuneration for the purpose of promoting the Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters.

Entrants consent to the Promoter retaining their personal information and to being contacted by the Promoters in relation to future promotions. If after receiving the first email from the Promoters the entrants wish to opt out of receiving further information, they may do so.

If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter the Promoter reserves the right, in their sole discretion, to the fullest extent permitted by law to disqualify any entrant or modify, suspend, terminate or cancel the Competition, as appropriate.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees (in which case that liability is limited to the greatest extent allowed by the law), the Promoters and any agencies associated with the Competition (including their respective directors, officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of or relating to:

the Competition;

any technical difficulties or equipment malfunction;

any theft, unauthorised access or third party interference;

any entry or Prize claim that is late, lost, altered, damaged or misdirected;

any variation in Prize value to that stated in these Terms and Conditions;

the delay, postponement or cancellation of any activity;

any tax liability incurred by a winner or entrant; or

the Prize or any part of the Prize, including, providing, delivering, accepting, taking, participating in or using the Prize or any part of the Prize.

The Promoters collect personal information (PI) in order to conduct the Competition and may, for this purpose, disclose such PI to third parties. Entry into the Competition and acceptance of the prize or any part of it is conditional on providing this PI. The Promoter will also use and handle PI as set out in their respective Privacy Policies, which can be viewed at jamaicablue.com.au/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policies, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning an entrant or the winner. The Privacy Policies contain information about how you may opt out, access, update or correct your PI, how you may complain about a privacy breach and how those complaints will be dealt with.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and/or place of residence) and reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful, improper or inappropriate conduct. Errors and omissions may be accepted at the Promoter’s discretion.

Any costs associated with entering the Competition are the responsibility of the entrant.
